The Israeli approach to advertising consists of two complementary sets of norms, legal norms and moral‐ethical norms. Advertising legislation demands honest disclosure. The Israeli legislator refrains from intervening in fundamental rights such as freedom of expression, free trade, occupation, and liberty of contract in advertising. However, there are also few interventions to prevent phenomena that are dangerous or abusive, especially to groups needing protection. The Israeli courts do try to apply moral considerations in cases tried by them, but living up (...) to moral responsibilities is different from complying with legal obligations. Advertisers in Israel have a(i) Treatise(r), consisting of ten ethical guidelines, which neither sums up advertising ethics in its entirety nor is legally binding. Sociological and psychological features of the culture need to be examined in order to spell out what truth and honesty in advertising actually mean in this society, and the manner in which these values are practised. Lacking sanctions in public law against misleading consumers or manipulation based on false facts, consumers must find remedy in civil actions which rely on moral and ethical rules. (shrink)

Basic human rights are supposed to protect people from abuse and harm. They are the means whereby we protect our humanity. One would expect, therefore, that basic human rights would be valid and sacred in any context, including industrial relations. However, the complexity of the employee–employer relationship obscures this issue, and it is not clear whether such rights can be protected or whether they are valid in the context of industrial relations. Since rights are relational, they are preconditioned on the (...) special nature of the relationship between employee and employer. Hence, the specific meaning that these rights have in industrial relations cannot be grounded in the notion of human rights as such, but rather depends on the special relationships between employers and employees. Though much legislation has been passed to regulate the relationship between employees and employers, the issues surrounding this relationship remain one of the most debated topics in business ethics. Our paper focuses specifically on the right to equal pay and the right to privacy. With respect to the right to property, the paper examines whether there is a conflict between general human rights and the fundamental right of employers to their property. The Israeli legislature has responded to this conflict by enacting ‘protective laws’ that legally outline and mandate certain human rights. Under these laws, employees are prevented and prohibited from waiving the rights granted to them by law, even if employed in private industries. Despite this legislative effort, market forces are at times stronger, and consequently some basic rights are not fully applied or implemented. (shrink)

I am enormously grateful to everyone who has contributed to this double issue of Philosophical Topics, to Manuel Dries and Joseph Schear for conceiving the issue and initiating the process of inviting contributions, and to Ed Minar and Jack Lyons, former editor and current editor of the journal respectively, for their excellent work in bringing the issue into existence. Each contribution displays a level of engagement with my book1 that would have been gratifying even if the contribution had been confined (...) exclusively to the chapter that is its immediate focus. What I have found most gratifying, however, is the sensitivity that the contributors have shown to the broader project of the book and to the various connections and patterns that I try to trace across chapters. I thank them warmly for this.In the preface to my book I comment on the fact that I am a philosophical generalist, and I go on to apologize to “all those whose expertise I may have propagated without acknowledgement, or mangled, or worst of all ignored” (MST, xix). The additional data, perspectives, questions, and criticisms contributed by the commentaries strengthen our view that local cortical processors coordinate their activity with the context in which it occurs using contextual fields and synchronized population codes. We therefore predict that whereas the specialization of function has been the keynote of this century the coordination of function will be the keynote of the next.

This article examines the implicit promises of fairness in evidence based medicine , namely to avoid discrimination through objective processes, and to distribute effective treatments fairly. The relationship between EBM and vulnerable groups is examined. Several aspects of EBM are explored: the way evidence is created , and the way evidence is applied in clinical care and health policy. This analysis suggests that EBM turns our attention away from social and cultural factors that influence health and focuses on a narrow (...) biomedical and individualistic model of health. Those with the greatest burden of ill health are left disenfranchised, as there is little research that is relevant to them, there is poor access to treatments, and attention is diverted away from activities that might have a much greater impact on their health. The acclaimed American sociologist and cultural philosopher Philip Rieff gained great academic prestige with his thesis on the emergence of 'Psychological Man' in western culture and with his classic book, Freud: The Mind of the Moralist, published in 1959. In this work and the later The Triumph of the Therapeutic (1966) he not only offered a highly original interpretation of the work of Sigmund Freud, but critically evaluated the enormous influence of psychotherapeutic thinking on Western culture. However, Rieff's later work (...) on the theory of culture did not garner the same attention, and his most recent writings have received very little critical engagement. In Sociology and the Sacred, Antonius A.W. Zondervan sets out to remedy this neglect, arguing that Rieff's work is ripe for intellectual reconsideration. (shrink)

The principles of equality and equity, respectively in the Bill of Rights and the white paper on health, provide the moral and legal foundations for future health care for children in South Africa. However, given extreme health care need and scarce resources, the government faces formidable obstacles if it hopes to achieve a just allocation of public health care resources, especially among children in need of highly specialised health care. In this regard, there is a dearth of moral analysis which (...) is practically useful in the South African situation. We offer a set of moral considerations to guide the macro-allocation of highly specialised public health care services among South Africa's children. We also mention moral considerations which should inform micro-allocation. (shrink)

A simple model of an exciton-phonon system is studied in connection with quantum chaos.

Schyns et al. make a strong case for context-dependent feature discovery. The features computed from specialized and diverse data-sets help to coordinate their activity by adapting so as to emphasize what is related across sets. Their perspective can be strengthened and extended by formal arguments for the contextual guidance of learning and processing and by neurobiological and psychological evidence of structures and processes that implement this guidance.

In this paper I argue that it is morally important for doctors to trust patients. Doctors' trust of patients lays the foundation for medical relationships which support the exercise of patient autonomy, and which lead to an enriched understanding of patients' interests. Despite the moral and practical desirability of trust, distrust may occur for reasons relating to the nature of medicine, and the social and cultural context within which medical care is provided. Whilst it may not be possible to trust (...) at will, the conscious adoption of a trusting stance is both possible and warranted as the burdens of misplaced trust fall more heavily upon patients than doctors. How are we to understand Aristotle's famous doctrine of the mean? "If ten pounds are too much for a particular person to eat and two too little, it does not follow that the trainer will order six pounds"... In fact, the relation of morality to physical health is more intimate than mere analogy. Emotions involve a bodily process (cp On the Soul 403al6ff): for example, 'Anger is productive of heat' (On the Parts ofAnimals 650b35), while 'Fear is, indeed, a kind (...) of chill' (Rhetoric 1389b32). The hot temper of youth and the cool temper of old age, to take two extremes, are corollaries of physical extremes, of literal heat and cold respectively (Rhetoric 1389a2ff). In general, moral as well as bodily excellences are supervenient upon physical states; specific to moral excellence is what it supervenes upon, viz bodily pleasures and plains (Physics 246b3-247a20, an early passage not relevantly superseded). Health and virtue are both grounded upon the physiological condition of a psycho-physical entity... Yet it is hard to view the physiology of virtue as more than a general precondition. It more satisfactorily identifies natural virtue than virtue proper. The blood of young men is heated by nature (as though by wine), so that they are hot-tempered and hopeful; this makes them less timorous and more confident, and so more courageous, than the old (Rhetoric 1389al8ff). But the properly brave man is one 'who faces and who fears the right things and from the right motive, in the right way and at the right time' (11 5b1b7ff). (shrink)

There is a widespread belief, more often implied than explicitly asserted, that Hume considered all necessary propositions to be analytic.Of course Hume did not use the analytic-synthetic distinction explicitly. This only come to the forefront with Kant; and it is Kant who is probably the main source of the above-mentioned belief. Kant ascribed to Hume the view that mathematical propositions are, in his terminology, analytic. If this is correct, then since mathematics was for Hume the paradigm of a body of (...) necessary truths, it is plausible to infer that he considered necessary propositions to be one and all analytic. The absence in Hume's writings of the analytic-synthetic terminology is by no means decisive: though he did not have the terms he may well have possessed the concepts, as evidenced by his use of them.
